About the Occupational Safety and Health Act 1984

The Occupational Safety and Health Act provides for the promotion, co-ordination, administration and enforcement of occupational safety and health in Western Australia. It also places emphasis in the duties of care on the prevention of accidents and injury or harm. In addition to the broad duties established by the OSH Act, the legislation is supported by a further tier of statute, commonly referred to as regulations , together with a lower tier of non-statutory codes of practice and guidance notes. If a regulation exists about a risk, you must comply with the regulation before any code of practice or guidance note. If there is no regulation about a risk but there is a code of practice or guidance note, you must either:. To assure safe and healthful working conditions for working men and women; by authorizing enforcement of the standards developed under the Act; by assisting and encouraging the States in their efforts to assure safe and healthful working conditions; by providing for research, information, education, and training in the field of occupational safety and health; and for other purposes. The Congress declares it to be its purpose and policy, through the exercise of its powers to regulate commerce among the several States and with foreign nations and to provide for the general welfare, to assure so far as possible every working man and woman in the Nation safe and healthful working conditions and to preserve our human resources The term "commerce" means trade, traffic, commerce, transportation, or communication among the several States, or between a State and any place outside thereof, or within the District of Columbia, or a possession of the United States other than the Trust Territory of the Pacific Islands , or between points in the same State but through a point outside thereof. The term "person" means one or more individuals, partnerships, associations, corporations, business trusts, legal representatives, or any organized group of persons. The term "employer" means a person engaged in a business affecting commerce who has employees, but does not include the United States not including the United States Postal Service or any State or political subdivision of a State.

This article addresses three key issues. First, the commonalities, differences, strengths, and limitations of existing occupational safety and health OSH legislation of low- and middle-income countries were determined. Second, required revisions were identified and discussed to strengthen the laws in accordance with the best international practice. Finally, proposals for additional OSH laws and interventions were suggested. A literature search of OSH laws of 10 selected low- and middle-income countries was carried out. The laws were subjected to uniform review criteria.

The aim of this manual is to promote safe work practices, to manage OHS risks, to inform staff and to assist in providing a safe environment for University staff and contractors, students and visitors.
